NRW Sports Association Faces Legal Limits in Excluding AfD Members

The Fußballverband Mittelrhein (FVM) in North Rhine-Westphalia (NRW) recently confronted a legal ruling that prohibits the exclusion of AfD party members from sports offices without risking its non-profit status. The NRW tax office clarified that amending statutes to bar AfD members would endanger the association’s tax-privileged status, citing the legal obligations for neutrality in non-profit organizations. Despite these tensions, the German Olympic Sports Confederation advocates for maintaining political neutrality while encouraging associations to update their statutes to effectively confront extremist behaviors. The Landessportbund NRW supports this nuanced approach, urging associations to clearly define and sanction actions that contradict democratic values rather than exclude members based on party affiliation.
