Over 1,000 German Jurists Call for AfD Party Ban Citing Democratic Threats

More than 1,000 legal experts in Germany, including lawyers, judges, prosecutors, and legal trainees, have signed an open letter urging the government and Bundestag to initiate legal proceedings to ban the far-right Alternative for Germany (AfD) party. This call was spearheaded by the Republikanischer Anwältinnen- und Anwälteverein (RAV), which initially gathered support from roughly 500 jurists in mid-July, with signatures now risen to 1,051.

The letter emphasizes the jurists' duty to uphold human dignity and the principles of democracy as guaranteed by Germany's Basic Law. The demand references a detailed legal report by the Gesellschaft für Freiheitsrechte (GFF), which reviewed over three million data points and concluded that the AfD's policies violate human dignity and democratic values. Such violations, if enacted, risk causing significant harm to the democratic order and many individuals.

Under Article 21, paragraph 2 of the Basic Law, political parties threatening the constitutional democratic order can be declared unconstitutional and subsequently banned by the Federal Constitutional Court. RAV chair Angela Furmaniak highlighted the necessity of employing this constitutional provision to address the AfD's anti-democratic activities.

The jurists have therefore called on the Bundestag and federal government to promptly file a petition with the Federal Constitutional Court to declare the AfD unconstitutional and enforce a ban. However, political response has so far been limited, and no consensus exists among political parties about pursuing such a ban. If initiated, the legal process could span several years before final resolution.

This development marks a significant legal challenge within German politics as prominent legal figures coalesce around concerns that the AfD's platform undermines constitutional order and human dignity, demanding urgent state intervention to safeguard democracy.
